Pehle Yeh Samjho: Bank Ya App Apne Aap Paisa Wapas Nahi Kar Sakta
Bahut log sochte hain ki UPI transaction cancel ho jaati hai ya NPCI automatically reverse kar deta hai — yeh galat hai. UPI transactions real-time final hoti hain. Jaise hi aapne "Pay" dabaya aur transaction successful hua — paisa receiver ke account mein settle ho gaya.
App aur aapka bank sirf receiver ke bank ko ek request bhej sakte hain paisa hold karne ya wapas karne ki. Agar receiver apna consent nahi deta — bank legally use force nahi kar sakta. Isliye legal process ka sahi knowledge hona zaroori hai.

PhonePe / GPay / Paytm Pe Complaint
Transaction hone ke baad jitna jaldi ho sake, app kholo aur us specific transaction pe jao:
- PhonePe: History → Transaction → "Need Help?" → "Raise a Dispute" → "Wrong Account Transfer"
- Google Pay: Activity → Transaction → "Report a problem" → "Sent to wrong person"
- Paytm: Passbook → Transaction → "Raise a Complaint"
Yeh complaint ek formal record ban jaata hai aur app receiver ke bank ko notification bhejta hai. Complaint number save kar lo.
Bank Ko Written Complaint — 3 Working Days Ke Andar
Saath hi apne bank branch mein ya netbanking/email se ek written complaint do jisme yeh details hon:
- Transaction ID / UTR number
- Date aur time of transaction
- Amount
- Receiver ka UPI ID ya account number (jo galti se select hua)
- Request: "Please initiate wrong credit reversal as per RBI guidelines"
Bank ek ticket generate karega aur receiver ke bank se formal credit reversal request karega. Yeh request receiver ke paise ke against ek hold ya lien nahi create kar sakti — sirf request hai. Lekin yeh aapki timeline ke liye evidence hai.
Step 2 — 30 Din Mein Bank Ne Kuch Nahi Kiya? NPCI + RBI Ombudsman
Agar 30 din baad bhi paisa wapas nahi aaya aur bank se satisfactory response nahi mila — ab aapke paas do escalation paths hain:

National Payments Corporation of India (NPCI) UPI ka governing body hai. Unhone ek dedicated helpline rakhi hai UPI dispute resolution ke liye. Call karke apna complaint number, transaction ID, aur bank complaint reference do. NPCI directly involved banks ko directive de sakta hai.
RBI Banking Ombudsman — cms.rbi.org.in
Yeh sabse powerful escalation hai. RBI Banking Ombudsman ke paas complaint daalte waqt:

- "File a Complaint" select karo — aapka bank select karo
- Category: "Digital Payments / UPI"
- Sari documents attach karo: bank complaint acknowledgement, app complaint screenshot, transaction proof
Ombudsman ke paas bank ke against order dene ki authority hai. Bank ko typically 30 din ke andar response dena hota hai warna penalty lagti hai.
Step 3 — Receiver Phir Bhi Mana Kare? Yeh 2 Laws Use Karo
Agar receiver directly mana kar raha hai — yeh sirf ek naitikata ka sawaal nahi raha, ab yeh criminal matter hai.
Indian Contract Act, Section 72 — Mistake Se Mila Paisa Wapas Karna Compulsory Hai
Section 72 of the Indian Contract Act, 1872 clearly kehta hai:
"A person to whom money has been paid, or anything delivered, by mistake or under coercion, must repay or return it."
Iska matlab: jo paisa galti se receiver ke account mein aaya — woh legally receiver ka nahi hai. Woh paisa aapka hai aur woh ise apne paas rakhne ka koi haq nahi rakhta. Yeh "unjust enrichment" hai — bina kisi kaam ya haq ke dusre ka paisa apne paas rakhna.
IPC Section 406 — Criminal Breach of Trust
Indian Penal Code, Section 406 (ab Bharatiya Nyaya Sanhita Section 316) criminal breach of trust ke liye 3 saal tak ki saza aur fine ka provision rakhta hai. Jab receiver ko pata hai ki paisa galti se aaya hai aur woh phir bhi use apne paas rakhne se mana karta hai — yeh criminal breach of trust hai.
Courts ne kai cases mein yeh maana hai ki wrong credit amount retain karna IPC 406 ke under punishable hai.

- Cyber Crime Helpline — 1930: Call karo aur "financial fraud / wrong transfer" report karo. Woh FIR register karne mein help karenge aur receiver ke account par hold lagwane ka process shuru ho sakta hai.
- cybercrime.gov.in: Online complaint file karo — "Financial Frauds" category mein. Transaction proof, receiver details, aur bank complaint evidence attach karo.
- Bank FIR + Section 72 Notice: Ek legal notice receiver ko bheji ja sakti hai (advocate se ya khud) Section 72 ICA quote karte hue — paisa 7 din mein wapas karo warna FIR + Consumer Court.
- Consumer Court: Agar bank ne theek se action nahi liya — aap bank ke khilaf Consumer Court mein bhi ja sakte hain deficiency of service ke liye.
