Workmen Compensation Act vs ESIC: Kaam Par Chot Lagey Toh Kaunsa Claim Karein?

Labour Law ESIC 22 October 2026

Kaam par accident ya occupational disease — yeh ek haadsa hai jo lakhs of workers ke saath hota hai. Lekin claim karne ke time confusion hoti hai: Workmen Compensation Act (WCA) 1923 ke under claim karein ya ESIC benefits lo? Dono ek saath nahi milte — yeh law mein clearly stated hai.

Core Rule — Section 53, ESI Act 1948: ESIC-covered employee WC Act ke under claim NAHI kar sakta — sirf ESI benefits milenge. Agar ESIC-covered nahi hai (salary Rs 21,000 se zyada ya non-covered industry), tab WC Act applicable hoga aur employer directly responsible hoga.

WC Act — Compensation Formula

Workmen Compensation Act mein compensation amount kaise calculate hota hai:

Death Case:

Compensation = 50% × Monthly wages × Age Factor

Minimum: Rs 1,20,000 | Maximum wages cap for calculation: Rs 8,000/month (pehle — Supreme Court ne higher wages pe bhi apply kiya)

  • Age Factor: Age 16 = 228.54 | Age 30 = 207.98 | Age 40 = 189.54 | Age 50 = 168.67
  • Plus funeral expenses Rs 5,000

Permanent Total Disability:

Compensation = 60% × Monthly wages × Age Factor

Minimum: Rs 1,40,000

Permanent Partial Disability:

Loss of earning capacity percentage × PTD compensation formula
