Is WFH a Legal Right in India?
There is no standalone WFH law in India yet. Your WFH arrangement is primarily governed by:
- Your employment contract / offer letter — if it mentions WFH, those terms apply
- Company HR policy — if policy promised WFH, it can't be arbitrarily changed
- Maternity Benefit Act — post-maternity WFH right if nature of work permits
- SEZ Rules for IT companies — DPIIT guidelines allow IT SEZ companies to implement WFH
Can Employer Change WFH Policy Suddenly?
This is the most common question post-pandemic — companies calling employees back to office after years of WFH.
The legal position:
- If your offer letter specifies WFH as a work arrangement — unilateral change may require your consent
- If WFH was an informal arrangement — employer can typically recall employees to office with reasonable notice
- Reasonable notice — generally 1–3 months is considered reasonable
- If you relocate to a different city for WFH and are then called back — employer should consider this (though legally complex)

Moonlighting (working for another employer during WFH) is generally not allowed if:
- Your employment contract has an exclusivity clause
- Your company policy prohibits dual employment
- The other work conflicts with your employer's business interests
