Who is Eligible for Maternity Leave?
You are eligible if:
- You are a female employee (permanent, contract, or daily wage)
- You have worked for at least 80 days in the last 12 months before the expected delivery date
- The employer has 10 or more employees
The law covers all establishments — factories, mines, shops, offices, IT companies, schools, hospitals — wherever 10+ people are employed.
How Much Leave Do You Get?

Of the 26 weeks, a maximum of 8 weeks can be taken before the expected delivery date. Remaining 18 weeks post-delivery.
Is Maternity Leave Fully Paid?
Yes — 100% of average daily wages.
Average daily wage = (wages paid in last 3 months / total days worked in those 3 months)
This includes basic salary, dearness allowance, and all regular allowances. Bonus, overtime, and commission may be excluded depending on your contract.

Work From Home After Maternity Leave

- Employer cannot arbitrarily deny without valid reason
Crèche Facility — Mandatory for 50+ Employees
If an establishment has 50 or more employees, providing a crèche facility is mandatory:
- Crèche within prescribed distance from workplace

- No extra deduction for crèche use
If no crèche, employer must pay a crèche allowance instead (amount depends on company policy/applicable rules).
Discharge Protection During Pregnancy
This is a critical right:
- Employer cannot dismiss or terminate a woman because of her pregnancy
- Employer cannot change service conditions to her disadvantage during pregnancy or maternity leave
- If dismissed during maternity period, she is still entitled to full maternity benefit
Violation is a criminal offense — punishable by imprisonment up to 1 year + fine.
Notice Requirements
To claim maternity benefit:
- Give written notice to employer about expected delivery date and intended leave period
- Attach a medical certificate from a registered doctor
- Typically given 6–8 weeks before expected delivery
If circumstances don't allow advance notice (emergency delivery, etc.), notice can be given after the fact with medical proof.
Medical Bonus
If the employer does not provide free prenatal care (checkup) and postnatal care, they must pay a medical bonus of ₹3,500.
What If Employer Denies Maternity Leave?
- Put it in writing — email HR clearly stating you're requesting maternity leave under Maternity Benefit Act
- If denied, file complaint with Inspector appointed under the Act (usually Labour Department)
- Criminal complaint can also be filed against the employer
- You can also approach the National Commission for Women if harassment is involved
Does ESI Cover Maternity?
If you are covered under ESIC (gross salary ≤ ₹21,000), maternity benefit comes through ESIC, not directly from employer.
ESIC maternity benefit: Full wages for 26 weeks (100% of average daily wages).
Condition: At least 70 days of ESI contributions in the last 2 contribution periods before expected delivery.
Male Employees — Paternity Leave
India does not have a central law mandating paid paternity leave for private sector employees. However:
