Salary slip mein "Income Tax" ya "TDS" ka deduction dikh ke log confuse hote hain — aur HR zyada explain nahi karta.
Section 192 — Employer Ki Obligation
Any person responsible for paying salary (employer, drawing and disbursing officer in government) ko Section 192 ke under TDS deduct karna mandatory hai agar employee ki estimated annual salary taxable limit se zyada hai.
Key points:
- TDS rate fixed nahi hota — aapki estimated total income aur slab ke hisaab se calculate hota hai
- Employer ke paas ye flexibility hai ki year ke alag-alag mahino mein alag amount katega (agar income change ho, year-end adjustment, etc.)
- Employer ko TDS deposit karna hota hai government account mein — 7th of following month (govt employees same day)
TDS Calculation Kaise Hoti Hai?
Start of year (April) mein employer yeh estimate karta hai:
- Estimated total salary for the year (all components)
- Plus: Other declared income (Form 12BB/12BAA se) — bank FD interest, rental, etc.
- Minus: Deductions declared — standard deduction, investments (Section 80C, 80D, NPS), HRA, home loan interest
- Net taxable income → Apply tax slabs → Annual tax liability
- Annual tax ÷ 12 = Monthly TDS
Agar mid-year mein aapka salary change hoti hai (increment, bonus), employer recalculates aur adjust karta hai remaining months mein.
Section 192 provisions, employer obligations, Form 16 issuance rules.
Form 12BB — Employee Ka Most Important Document
Form 12BB aapko April mein (year beginning) employer ko submit karna chahiye. Isme aap declare karte ho:
- HRA: Rent amount, landlord name/PAN (agar rent > ₹1 lakh/year)
- LTA: Leave Travel Allowance claim
- Home loan: Interest paid (lender name, amount, property address)
- Investments (Chapter VIA): 80C, 80D, 80E, 80G, etc.
Agar Form 12BB sahi se submit karoge, employer accordingly TDS kam kaatega. Agar submit nahi kiya toh employer conservative (higher) TDS kaatega.
Form 12BAA (naya, 2024 mein introduced): Isme aap declare karte ho agar koi TDS kahin aur kat raha hai (bank FD, rent receipts, etc.) toh employer salary TDS mein adjust kar sake.
TDS Certificate — Form 16
Employer ko har salaried employee ko Form 16 issue karna hota hai by June 15 of following year. Form 16 ke do parts hain:
- Part A: TDS certificate — quarterly TDS deducted aur deposited amounts, employer TAN, employee PAN
- Part B: Salary details, deductions claimed, total taxable income, total tax paid
Form 16 hi primary document hai ITR filing ke liye salaried employees ke liye. Isko TRACES portal se download bhi hota hai.
Zyada TDS Kata — Refund Kaise Milega?
Koi bhi excess TDS ITR file karte waqt claim kar sakte ho. Steps:
- Income Tax portal par ITR file karo — sahi deductions claim karo jo Form 12BB mein miss ho gayi thi
- Tax liability calculate hogi — agar TDS zyada kataaya tha toh excess refund amount dikhega
- Bank account verify karo (linked in IT portal)
- Refund typically 4–8 weeks mein bank mein aa jaata hai ITR verification ke baad
Employer Form 16 download, TDS reconciliation, challan verification.
Employer Ne TDS Nahi Diya CBDT Ko — Aapka Kya Hoga?
Ek common problem: Employer ne salary se TDS kaat liya lekin CBDT ko deposit nahi kiya. Aapke Form 26AS mein yeh credit nahi dikhega. Aap ITR mein claim karoge lekin department demand raise kar sakta hai.
Rights:
- Form 26AS daily check karo (April-June mein) — TDS reflect hona chahiye
- Agar employer ne kaat ke deposit nahi kiya, IT department notice employer ko bhejega, not you
- Supreme Court judgments ke mutabiq, employee bona fide hai toh TDS credit milega even if employer defaulted — lekin ITR processing delay ho sakti hai
- TRACES portal par TDS deductor details verify karo
Bona fide TDS credit, employer default, employee protection.
