Employee Ke Liye Process

Maan lijiye aapke bank FD se Rs 50,000 interest aaya aur bank ne 10% TDS (Rs 5,000) kat liya. Ab salary se bhi employer poori salary TDS kat raha hai bina us Rs 5,000 ka credit diye. Result: aap ITR mein refund maangte ho aur process slow ho jaati hai.

Iska solution hai Form 12BAA — CBDT ne October 2024 mein Notification No. 112/2024 ke zariye yeh new form introduce kiya. Isse employee apne other income sources par pehle kata gaya TDS employer ko inform kar sakta hai taaki salary ke TDS calculation mein use credit de sake.

Form 12BAA Introduce Kyun Kiya Gaya?

Pehle sirf Form 12BB tha — jisme employee investments (80C, 80D), HRA, LTA etc. declare karta tha. Lekin other sources (bank FD, dividends, rental income, freelance) ka TDS declare karne ka koi official form nahi tha.

Section 192(2B) of Income Tax Act allows employers to consider TDS from other sources while computing salary TDS — lekin koi standard form nahi tha. Ab Form 12BAA yeh gap fill karta hai.

Effective date: CBDT Notification No. 112/2024, dated October 15, 2024. Yeh form FY 2024-25 se applicable hai.

Form 12BAA Mein Kya Fill Karein?

Form 12BAA mein employee ko declare karna hoga:

Yeh declaration employee sign karke employer ko deta hai — ek written undertaking ki yeh information correct hai. Agar baad mein galat niklega toh responsibility employee ki hogi.

Employer Is Information Ka Kya Karta Hai?

Employer salary TDS calculate karte waqt:

  1. Employee ki total estimated income for the year compute karta hai (salary + other declared income)
  2. Total applicable tax calculate karta hai
  3. Other sources par already deducted TDS credit deta hai
  4. Remaining tax liability salary se monthly deduct karta hai

Iska fayda: Salary se over-deduction avoid hoti hai. Aapko year-end mein ITR mein refund claim nahi karna padta — TDS already calibrated hoti hai.

Form 12BAA Vs Form 12BB: Dono Zaruri Hain

FormKya Declare KarnaKab Bharna
Form 12BBInvestments (80C, 80D, NPS), HRA, LTA — employer se tax saving ke liyeFinancial year ke shuru mein (April–May)
Form 12BAAOther income aur already deducted TDS — over-deduction se bachne ke liyeJab bhi other income change ho — quarterly update karna best practice hai

Dono forms ek dusre ke complement hain — Form 12BB tax bachata hai, Form 12BAA TDS credit ensure karta hai.

Kya Yeh Mandatory Hai?

Filling Form 12BAA optional hai — employee ko dena zaruri nahi. Lekin agar aap nahi dete toh employer ko other income TDS credit dene ki koi obligation nahi — woh salary par full tax compute karega aur zyada TDS kaatega. Baad mein ITR mein aap refund claim kar sakte hain, lekin that takes time.

Agar FD interest substantial hai (Rs 40,000+ per year for senior citizens, Rs 40,000 per year general) ya aaapke multiple TDS sources hain toh Form 12BAA banana clearly beneficial hai.

Form Kahan Se Milega?
