Property Bechne Se Pehle Yeh Ek Document Banao — Capital Gains Tax Legally Bachao
- 1CBDT-registered valuer ko hire karo
- 2Woh property ki value 1 April 2001 ke din ki certify karta hai
- 3Yeh FMV tumhari cost of acquisition ban jaati hai
- 4Cost zyada = taxable gain kam = tax bachega
| Without Valuer | With Valuer |
|---|---|
| Low cost base | High FMV base |
| High capital gain | Low capital gain |
| High tax | Less tax |
| IT notice risk | Court-proof |
- CBDT registered valuer ki FMV report (1.4.2001 ki date pe)
- Original purchase deed / khaata papers
- Improvement cost ka bill/receipt (agar renovation ki thi)
- Sale deed aur registry documents
- ITR mein capital gains schedule sahi se bharein
Ek Daman ki family ne apni purani zameen ₹92 lakh mein bech di. Tax sahi diya — kyunki unke paas ek registered valuer ki report thi jisme 1 April 2001 ki property value certified thi. Lekin 7 saal baad ek Income Tax officer aaya aur bola: "Aapne tax fraud kiya hai, itna zyada tax dena hoga."
Woh family sidha High Court gayi. Court ne officer ka poora notice reject kar diya — do dum seedhi wajahon ke saath.
Yeh wajahaat samajh lo — kyunki yeh sirf uss family ki baat nahi. Agar tumhare ghar mein bhi koi purani property hai jo kabhi bechni padegi, toh yeh article tumhare liye hai.
Pehle Samjho: Capital Gains Tax Hota Kya Hai Property Bechne Pe?
Jab tum koi property — zameen, makaan, plot — bechte ho, toh jo munafa hota hai usse capital gain kehte hain. Government us munafe pe tax leta hai.
| Type | Holding Period | Tax Rate |
|---|---|---|
| Short-Term Capital Gain (STCG) | Property 24 mahine se kam rahi ho | Normal slab rate |
| Long-Term Capital Gain (LTCG) | Property 24 mahine se zyada rahi ho | 12.5% (post July 2024) |
Formula simple hai: Capital Gain = Sale Price − Cost of Acquisition − Improvement Costs
Ab problem yahan aati hai — agar tumhare daada ne 1985 mein koi zameen ₹50,000 mein kharidi thi, aur aaj uski value ₹1 crore hai, toh kya sach mein ₹99.5 lakh pe tax dena hoga? IT Act kehta hai — nahi.
Section 55(2)(b) — Woh Law Jो Pre-2001 Property Walon Ko Bachata Hai
Income Tax Act ki Section 55(2)(b) clearly kehti hai: agar koi property 1 April 2001 se pehle acquire ki gayi thi, toh tumhare paas option hai ki cost of acquisition ke roop mein 1 April 2001 ki Fair Market Value (FMV) lo.
Matlab — 1985 ki ₹50,000 ki jagah tum 2001 ki FMV use kar sakte ho — jo shayad ₹8-10 lakh hogi. Ab gain calculate hoga ₹1 crore minus ₹8-10 lakh. Tax kaafi kam ho jaata hai.
Lekin yeh FMV kaise prove karoge? Yahan aata hai woh ek document.
Registered Valuer Report — Woh Ek Kaagaz Jis Pe Sab Depend Karta Hai
CBDT (Central Board of Direct Taxes) ke paas registered valuers ki list hai — certified professionals jo legally property ki value certify kar sakte hain. Jab tum property sell karne se pehle inka certificate banwa lete ho, toh woh document court mein bhi valid hota hai.
Yeh report batati hai: "Is property ki value 1 April 2001 ke din ₹X thi." Aur yahi tumhari cost of acquisition ban jaati hai Income Tax return mein.
Amitabh Bachchan ho ya dhoni, koi bhi samajhdar aadmi property bechne se pehle yeh document zaror banwata hai. Kyunki IT department baad mein agar bole ki "aapne kam cost dikhaayi" — tumhare paas certified proof hai.
Is report ke bina agar IT officer purani kharid price pe tax lagaye, toh tum defend nahi kar sakte. Iss report ke saath — tum court mein bhi jeete ho.
Daman Family Ka Real Case — Court Ne IT Notice Ko Seedha Reject Kiya
Ek Daman ki family ne apni purani zameen ₹92 lakh mein bech di. Unhone registered valuer ki FMV report ke basis pe capital gains calculate kiye aur tax diya. Sab kuch sahi tha.
7 saal baad Income Tax officer aaya aur claim kiya ki property ki actual value zyada thi, aur unhone tax fraud kiya hai. Massive tax demand bheja.
Family High Court gayi. Court ne do dum seedhi baatein kahi:
- Registered valuer ki report valid hai. Agar taxpayer ne CBDT-registered valuer se FMV certify karwaayi thi, toh IT department bina strong counter-evidence ke us value ko challenge nahi kar sakta.
- Notice time-barred tha. Income Tax Act ki limitation ke according, IT department 3 saal se zyada purani sale pe reassessment notice nahi bhej sakta (chote amounts ke liye). Is case mein 7 saal ho chuke the — notice completely invalid tha.
Court ne notice reject kiya. Family ko ek paisa extra nahi dena pada.
3 Saal Ki Limitation — IT Wale Iske Baad Notice Nahi De Sakte
Yeh second point bahut zaroori hai. Income Tax Act Section 149 kehta hai:
| Condition | Notice Time Limit |
|---|---|
| Escaped income ₹50 lakh se kam | 3 saal tak hi notice valid |
| Escaped income ₹50 lakh se zyada | 5 saal tak notice valid |
| Foreign assets / serious fraud cases | Up to 10-16 saal (special cases) |
Aam property sale mein, agar 3 saal nikal gaye sale ke baad — aur IT officer notice bhejta hai "aapne galat capital gains dikhaayi" — toh woh notice legally invalid hai. Supreme Court ne bhi multiple cases mein is limitation ko uphold kiya hai.
Iska matlab: agar tumne 2020 mein property bech di, sahi ITR file ki, aur aaj 2026 mein koi notice aaye — toh tum High Court mein directly challenge kar sakte ho. Notice survive nahi karega.
Registered Valuer Kaise Dhundo — Step by Step
- CBDT ki official website pe jaao. IBBI (Insolvency and Bankruptcy Board of India) aur CBDT dono registered valuers ki directory maintain karte hain.
- Category dekho. Property ke liye "Land & Building" category ka valuer chahiye.
- Local valuer prefer karo. Jo tumhare city ya district ke property rates jaanta ho — uski report zyada believable hoti hai IT department ko.
- Documents de do. Original purchase deed, khasra/khatoni, location details, construction details agar makaan hai toh.
- Report mein clearly mention ho. "Fair Market Value as on 1st April 2001 = ₹X" — yeh line zaroori hai.
- Fees. Typically ₹3,000 – ₹15,000 depending on property size. Ek baar ka kharcha — lakho ka tax bachata hai.
ITR Mein Capital Gains Kaise Report Karein
Property sale hone ke baad ITR-2 ya ITR-3 file karni hoti hai (ITR-1 mein capital gains nahi hota). Form ke andar Schedule CG (Capital Gains) section hota hai.
- Full Value of Consideration: Sale price (ya stamp duty value — jo bhi zyada ho, Section 50C ke under)
- Cost of Acquisition: Registered valuer ki FMV report wali value (agar pre-2001 property)
- Cost of Improvement: Renovation ya construction pe lagaaye paise (bills/receipts rakho)
- Net LTCG: Iske baad 12.5% tax lagega
Ek important baat: Section 50C kehta hai agar sale price stamp duty circle rate se kam hai, toh IT circle rate ko sale price maanega. Is liye sale price hamesha circle rate ke barabar ya zyada rakhne ki koshish karo. Agar less hai, toh Section 50C(2) ke under valuation petition daal sakte ho.
Agar IT Notice Aa Jaaye Toh Kya Karein?
Sabse pehle ghabrana band karo. Notice aane pe:
- Date check karo. Notice ki date aur sale ki date. Agar 3 saal se zyada ka gap hai — seedha challenge ho sakta hai.
- Registered valuer report nikaalo. Yeh tumhara sabse bada weapon hai.
- CA ya tax advocate se milو. Reassessment notices mein proper reply important hai — khud mat likho.
- CIT(A) ya High Court. Agar notice invalid lag raha ho — appeal time-limit ke andar dalo. Daman family ki tarah court se relief mil sakti hai.
Yeh mat socho ki notice aaya matlab paisa dena hi padega. Bahut baar notice galat ya time-barred hota hai — aur courts ne baar baar taxpayer ke saath khade hokar aisi notices reject ki hain.
