Companies Overtime Register Kyun Bana Rahi Hain?

Aajkal kaafi factories aur companies apne employees ka overtime register banwa rahi hain. Reason simple hai — agar koi inspection ya complaint aaye, toh unke paas record hona chahiye. Lekin iska matlab yeh bhi hai ki law ka pressure kaam kar raha hai.

Overtime Ka Double Pay Rule — Section 59

Section 59 of the Factories Act crystal clear hai: agar kisi worker se weekly limit (48 ghante) se zyada kaam karaya gaya, toh use normal rate ka DOUBLE pay karna zaroori hai.

"Where a worker works in a factory for more than nine hours in any day or for more than forty-eight hours in any week, he shall, in respect of overtime work, be entitled to wages at the rate of twice his ordinary rate of wages."

Monthly working hours = 26 din × 8 ghante = 208 assumed. Aapke factory ke actual days se calculate karein.

Bina Consent Ke Overtime Illegal Hai

Ek baat jo bahut log nahi jaante: company aapko force nahi kar sakti overtime karne ke liye bina aapki sehmat (consent) ke. Overtime voluntary hona chahiye.

Agar supervisor ya manager pressure deta hai "shift extend karo warna job jaayegi" — yeh intimidation hai aur labour law ke against hai. Aap isko bhi complaint mein mention kar sakte hain.

Ek important limit aur hai — Section 64 ke under ek quarter (3 mahine) mein sirf 50 ghante overtime allowed hain (kuch states mein 75 ghante tak). Isse zyada kaam karana bhi violation hai, chahe double pay dein ya nahi.
