"Use It or Lose It" Ab Illegal Hai

Purane Factories Act ke under maximum 30 days ki earned leave carry forward hoti thi. Agar aapke paas 47 din the — December mein 17 din silently lapse ho jaate the. Koi notice nahi, koi payment nahi.

OSH Code 2020 ne yeh limit badhakar 300 days kar di hai. Ab koi bhi company policy jo leaves ko 30 ya kisi arbitrary limit par lapse kare — woh naye kanoon ka direct violation hai.

Earned leave accrual rate: 1 day per 20 working days — yaani ek saal mein ~13–15 din. Consistently kaam karo, chhuttiyaan mat lo — 2 saal mein 30 ka limit aa jaata hai.

Pehle ka rule: encashment sirf resignation ya retirement par. Isliye log job mein rehte hue chhuttiyaan bacha ke rakhte the — fayda koi nahi tha jab tak job nahi chodte.

OSH Code 2020, Section 32 ke under, ab koi bhi worker apni accumulated earned leave ko service mein rehte hue bhi encash kar sakta hai. HR ko formal written application do — yeh aapka statutory right hai.

HR Ne Reject Kiya? Leave Fir Bhi Aapki Hai

Boss ne leave reject kar di — "urgent project hai." Pehle us leave ka koi hisaab nahi hota tha. Ab aise nahi.

OSH Code ke under, agar management aapki earned leave application refuse karti hai, toh woh leave automatically aapke credit mein carry forward hogi — bina kisi limit ke, 300 days ki cap tak. HR us leave ko zero nahi kar sakti.

Practical matlab: Jitni zyada baar HR "no" bolta hai — utni zyada encashment value build hoti hai aapke account mein. Har reject = ek aur din credit.

HR ko email karo. Subject: "Request for Leave Encashment under OSH Code 2020, Section 32." Law ka naam likhne se companies seriously lete hain.
