Naukri chhodni ke baad ya retirement ke time milne wali leave encashment — yaani unused earned leaves ka cash payment — par tax exempt hoti hai ek limit tak. Budget 2023 mein ek important change aaya: private sector employees ke liye yeh limit Rs 3 lakh se badha ke Rs 25 lakh kar di gayi (Section 10(10AA)). Yeh change April 1, 2023 se laagu hua.

Agar aapne 2023 ke baad ya baad mein leave encashment li hai, toh naya limit apply hoga. Is article mein calculation, eligibility conditions aur ITR mein claim karna samjhate hain.

Leave Encashment Kya Hai?

Leave encashment yaitu kisi employee ko unki accumulated earned/privilege leaves ka paise mein payment. Yeh do tarah hoti hai:

Yeh article exit ke time milne wali leave encashment par focus karta hai, jo employer ke F&F settlement ka part hoti hai.

Exemption Limit: Rs 3 Lakh Se Rs 25 Lakh Ka Safar

Section 10(10AA) mein private employees ke liye leave encashment exemption limit 1987 se Rs 3 lakh thi — decades tak kabhi nahi badli. Budget 2023 (Finance Act 2023) mein Rs 25 lakh kar di gayi, effective April 1, 2023.

PeriodExemption Limit (Private Employees)
Pre-April 2023Rs 3,00,000
April 2023 onwardsRs 25,00,000
Government employees (always)No limit — full exemption under Section 10(10AA)(i)

Ek employee apni poori service mein multiple employers se milne wali exempt leave encashment ka total Rs 25 lakh tak exempt rakh sakta hai — yeh lifetime limit hai, per employer nahi.

Exact Calculation: Teen Conditions Mein Se Minimum

Private employees ke liye exempt amount = Minimum of:

  1. Actual leave encashment received
  2. Rs 25,00,000 (statutory limit)
  3. 10 months ki average salary (last 10 months ke basic + DA ka average × 10)

Example calculation:

ScenarioEncashment Received10-Month SalaryExemptTaxable
A — Small encashmentRs 5,00,000Rs 12,00,000Rs 5,00,000 (all exempt)Rs 0
B — Medium encashmentRs 18,00,000Rs 10,00,000Rs 10,00,000Rs 8,00,000
C — High encashmentRs 30,00,000Rs 28,00,000Rs 25,00,000 (ceiling)Rs 5,00,000

Practically, majority employees jo 10+ saal service karte hain unki 10-month salary often Rs 25 lakh se kam hogi — so for most employees, Condition 3 (10-month salary) will be the binding limit.

Kab Taxable Hogi?

Leave encashment taxable hoti hai jab:

Old Tax Regime vs New Tax Regime

Section 10(10AA) exemption dono regimes mein apply hoti hai — old tax regime aur new tax regime (Section 115BAC) dono mein. Yeh Section 10 exemption hai, Section 80 deduction nahi, isliye new regime mein bhi available hai.

Important: Standard deduction, HRA, LTA jaise exemptions new regime mein available nahi hain — lekin leave encashment (Section 10(10AA)), gratuity (Section 10(10)), aur VRS compensation (Section 10(10C)) dono regimes mein exempt hain.

ITR Mein Kaise Claim Karein?

Steps:

  1. Employer se Form 16 lein — leave encashment amount "perquisites/other salary" ya specific head mein dikhai degi
  2. ITR form (ITR-1 ya ITR-2) mein "Salary" schedule mein "Exempt u/s 10" section open karein
  3. Section 10(10AA) select karein
  4. Exempt amount calculate karo (minimum of 3) aur fill karein
  5. Taxable balance normal salary mein add hoga

Agar employer ne Form 16 mein already correct exemption calculate ki hai, toh aapko alag se kuch karna nahi — bas check karein ki amount theek hai.
