Diwali Bonus HR Ko Email Kaise Likhein 2026: Law, Eligibility, Sample Email — Code on Wages Guide

Bonus Law Code on Wages 22 October 2026

Diwali aate hi ek common sawaal aata hai: "HR ko bonus ke baare mein email karein toh kya likhein?" Bahut log galat claims karte hain — "Diwali se pehle dena zaroori hai" ya "CTC pe calculate hoga" — aur isse HR response nahi deta ya relationship kharab hoti hai. Sahi tarika yeh hai ki law pe based, polite, factual email likhein.

Code on Wages, 2019 ka Bonus chapter officially 21 November 2025 se in force aa gaya hai (S.O. 5322(E)). Iske baad do important notifications aaye — S.O. 4711(E) aur S.O. 4710(E), dono dated 25 August 2026 — jinse eligibility aur calculation ceiling update hui hai.

Key Law Update 2026: S.O. 4711(E) — Wage eligibility ceiling: Rs 21,000/month | S.O. 4710(E) — Calculation ceiling: Rs 7,000 or applicable central minimum wage, whichever is higher | Section 26 — Minimum 8.33%, maximum 20% | Wages = Basic + DA only, not CTC.

Section 39 Aur "Diwali Deadline" Myth

Ek common misconception hai ki bonus Diwali se pehle dena legally mandatory hai. Yeh sahi nahi hai.

Section 39 kehta hai: bonus accounting year khatam hone ke 8 mahine ke andar dena hoga. Agar aapki company ka accounting year April se March hai, toh deadline 30 November hai — aur yeh coincidentally Diwali season ke qareeb padta hai. Lekin agar accounting year different hai (January-December, July-June), toh deadline bhi alag hogi. 30 November ek universal Diwali deadline nahi hai — yeh April–March accounting year ka result hai.

HR email mein yeh claim mat karein: "As per law, you must pay bonus before Diwali." — Yeh factually incorrect hai aur aapki credibility khatam kar sakta hai. Sahi approach: apni company ke accounting year ke hisaab se Section 39 ki timeline mention karein.

Eligibility Checklist — Kya Aap Bonus Ke Liye Eligible Hain?

Bonus Eligibility Checklist (Code on Wages, 2026)

  • Aapki monthly wages (Basic + DA) Rs 21,000 ya usse kam hain (S.O. 4711(E), 25 Aug 2026)
  • Aapne accounting year mein kam se kam 30 din kaam kiya hai (Section 26(1))
  • Aapka employer Government establishment nahi hai (bonus chapter Government establishments par apply nahi hota)
  • Aap regular employee hain — apprentices is provision ke bahar hain
  • Wages mein sirf Basic aur DA count hoga — HRA, conveyance, special allowances included nahi hain
  • Aapki company ka accounting year confirm kiya hai — isse Section 39 ki actual payment deadline pata chalegi

Sample HR Email — Bonus Enquiry (Simple English)

Neeche ek polite, factually grounded email template hai. Yeh generic hai — apna naam, company details aur accounting year dates fill in karein:

Calculation Example — Illustration Only

Neeche ek illustrative example hai — yeh actual payment amount guarantee nahi karta. Actual bonus company ke allocable surplus, set-on/set-off rules aur employer's discretion (8.33% se 20% ke beech) par depend karta hai.

Bonus Calculation — Illustration (Not a Guarantee)

ILLUSTRATION ONLY
StepDetailAmount
Employee monthly wages (Basic + DA)Assume Rs 18,000/month — within Rs 21,000 ceilingRs 18,000
Calculation ceiling applies?S.O. 4710(E): ceiling is Rs 7,000 or central min wage, whichever higher. Assume central min wage is Rs 8,000 — so ceiling = Rs 8,000Rs 8,000/month
Annual wages for bonus calculationRs 8,000 × 12Rs 96,000
Minimum bonus @ 8.33%Rs 96,000 × 8.33%Rs 7,997 (~Rs 8,000)
Maximum bonus @ 20%Rs 96,000 × 20%Rs 19,200

Note: Actual bonus depends on company's allocable surplus and set-on/set-off. If actual wages are below the ceiling (e.g. Basic + DA = Rs 6,500/month), actual wages are used, not the ceiling. Central minimum wage in your region must be verified from official notification — the Rs 8,000 above is illustrative only.

Email Mein Kya Nahi Likhein

  • Yeh mat likhein: "Law ke according Diwali se pehle bonus dena zaroori hai" — Section 39 accounting year se linked hai, Diwali se nahi
  • Yeh mat likhein: "Mera CTC Rs X hai isliye bonus Rs Y hona chahiye" — wages mein CTC nahi, sirf Basic + DA count hota hai
  • Yeh mat likhein: Threatening tone ya legal action ki direct warning — pehle polite enquiry, dialogue se zyada result milta hai
  • Yeh mat likhein: Specific amount demand karo without knowing company's surplus — minimum 8.33% ka haq hai, lekin actual amount surplus par depend karta hai

Agar HR Ne Jawab Nahi Diya — Agle Steps

Agar polite email ke baad bhi koi response nahi aata ya bonus denied kiya jaata hai bina valid reason ke:

  1. Written follow-up: 15 din baad second email karein, pehli email ka reference dein
  2. HR Manager / Labour law compliance officer: Escalate karein internal grievance channel se
  3. Labour Inspector: Code on Wages ke under concerned authority ko complaint file kar sakte hain
  4. Shram Suvidha Portal: Online complaint filing available hai — shramsuvidha.gov.in

Remember: Bonus ek statutory right hai eligible employees ke liye — gift ya ex-gratia nahi. Lekin tone professional aur factual rakhna best practice hai, specially initial communication mein.
